US Court Mandates Freedom of Abrego Garcia from Immigration Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.

In her decision, the judge pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in Tennessee.

The court, who was overseeing his petition to removal in a Maryland district court, determined that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
